License Agreement
End-User License Agreement for WJ-ND300 Administrator Console Software (the “SOFTWARE”)
The following is a legal agreement between you and Panasonic. Carefully
read all the terms and conditions of this Agreement prior to installing
the SOFTWARE. Installing the SOFTWARE indicates your acceptance of
these terms and conditions. If you do not agree to these terms and
conditions, either delete the copy of the SOFTWARE from your computer’s
hard drive (if you downloaded the SOFTWARE) or return the SOFTWARE
(if you received the SOFTWARE on a CD-ROM).
- Copyright: You acknowledge
that you are receiving only a limited license to use
the SOFTWARE and related documentation, and that you shall obtain
no title, ownership nor any other rights in or to the SOFTWARE
and related documentation, all and any portion of which title
and rights shall remain with Panasonic and/or its licensor.
- License and Restrictions: You have the
non-exclusive right to use the SOFTWARE within the United
States in connection with your WV-NW474 camera
(the “Product”). You may not (a) copy the SOFTWARE, except as
reasonably necessary for internal back-up purposes, (b) use and/or
transfer the SOFTWARE to any third party apart from the Product,
(c) modify the SOFTWARE, (d) attempt to reverse engineer, decompile
or disassemble any portion of the SOFTWARE or (e) export the SOFTWARE
in contravention of any applicable U.S. or foreign export law
or regulation.
- Support: The SOFTWARE is not intended for use outside
of the United States. Panasonic will not provide support with
respect to the SOFTWARE to persons located outside of the United
States.
- Term: This license is effective until terminated. You
may terminate this Agreement at any time by destroying the SOFTWARE
and related documentation and all copies thereof. This license
will also terminate if you fail to comply with any term or condition
of this Agreement. Upon such termination, you agree to destroy
the SOFTWARE and related documentation and all copies thereof.
- Limitation of Liability: The SOFTWARE is provided “as
is” without any warranty. Except as expressly provided herein,
neither Panasonic nor Panasonic’s licensor makes or passes on
to you or other third party any warranty or representation, including,
but not limited to, the implied warranties of merchantability
and fitness for a particular purpose. Without limiting the generality
of the foregoing, neither Panasonic nor Panasonic’s licensor warrants
that the SOFTWARE will be error-free or that it will meet your
requirements. Neither Panasonic nor Panasonic’s licensor shall
be liable for any damage suffered by you, including, but not limited
to, consequential, incidental, indirect, special, exemplary or
punitive damages. The above limitations shall apply regardless
of the form of action, whether in contract, tort (including negligence),
strict product liability or otherwise, even if Panasonic or Panasonic’s
licensor has been advised of the possibility of such damages.
