Early Bird Promotion Period: May 25th 2021 – August 31st 2021
Claim Period: July 1st 2021 - September 15th 2021
1.1. LUMIX GH5M2 Early Bird Promotion (hereafter referred to as the "Promotion") is promoted by Panasonic Marketing Europe GmbH, whose registered address is Hagenauer Str. 43, 65203 Wiesbaden, Germany (the "Promoter").
2.1. The Promotion is applicable to residents of the following countries: Germany, Austria, France, DROM-COM [euro zone only], Monaco, Belgium, Luxembourg , Italy, Switzerland, Netherland, Spain, Portugal, Poland, Czech Republic, Slovakia, Hungary, Romania, Bulgaria, Slovenia, Croatia, Estonia, Lithuania, Sweden, Denmark, Norway, Finland, UK and Ireland, Bosnia & Hercegovina, Albania, Latvia, Greece (“Participating Countries”).
2.2. The participants must be at least 18 years old (“Participant”).
2.3. To participate in the Promotion, the Participant has to purchase one of the following LUMIX GH5M2 products: DC-GH5M2E, DC-GH5M2LE, DC-GH5M2ME (“Qualifying Products”) from an authorized retailer in a Participating Country in the period from May 25th 2021 to August 31st 2021 (“Early Bird Promotion Period”) and answer a survey which will be provided to them during the claim process and requests the information stated in clause 4.
2.4. All Qualifying Products must be new and genuine Panasonic products. Purchases of second hand, refurbished or reconditioned products, and products imported from outside the Participating Countries or products which are counterfeit or infringe the intellectual property rights of the Panasonic group of Companies in any way will not qualify for this Promotion.
3.1. The Gift provided for participating in the Promotion is a H-H025 25mm F1.7 lens and a free battery DMW-BLK22 (“Gift”).
3.2. The Gift offered under this Promotion is non-exchangeable, non-transferable and there is no cash or credit alternative available.
3.3. The Promotion is offered only while stocks of the Gift last.
3.4. In the event of unforeseen circumstances, the Promoter reserves the right to provide an alternative Gift of the same or greater value without giving notice.
4. CLAIM PROCESS
4.1. To claim the Gift, the Participant must register the claim online and take part in the survey linked to on the registration landing page at here, once a Qualifying Product is purchased. The Participant must fully complete and submit the survey to be eligible for the Gift.
4.2. Claims relating to Qualifying Products purchased before or after the Early Bird Promotion Period will be deemed invalid.
4.3. To claim the Gift the Participant has to make a registration for its redemption by providing the following mandatory information at the landing page stated in clause 4.1:
1) Where the Qualifying Product was purchased?
2) Date of purchase
3) Serial number of the Qualifying Product (which can be found on the base of the product or the side of the product box)
4) Uploaded scan/photograph of of the image of the serial number and the barcode
5) Uploaded scan/photograph of the invoice/receipt of purchase (copy of the full purchase receipt (not deposit receipt or pre-order receipt).
4.4. The time period for making the claim is from July 1st 2021 to September 15th 2021 (“Claim Period”). Applications made after the Claim Period will not be eligible for the Promotion. The Participant should ensure the purchase receipt includes the product name (model number) purchased, price paid, store name and the date of purchase.
4.5. The Promoter will not be held responsible or liable for any technical, hardware, software, server, website or other failures or damage of any kind, to the extent that this prevents the Participant from or otherwise obstructs the Participant to enter in the Promotion.
4.6. Claims made by fax, telephone, email or post will not be accepted. Illegible, incomplete or altered claim forms or surveys will be deemed void, as will claim forms not completed in accordance with these terms and conditions.
4.7. Upon submission of the online registration Participants will be sent an automated email to confirm the receipt of their claim and the next steps of the claim process. The Participant´s claim will be verified in accordance with these terms and conditions. Claims are not valid in respect of Qualifying Products that are returned to a retailer and the Participant exchanges the Qualifying Product or receives a full refund, in which case the Promoter will be entitled to claim back any Gifts provided.
4.8. The Promoter will not process a claim if the Participant does not provide a valid copy of the purchase receipt, the product serial number and image of the serial number and barcode.
5. REDEMPTION PROCESS
5.1 The Gift will be sent to the address provided by the Participant when registering for the claim.
5.2. If a Gift is undeliverable because of an invalid or incorrect address is provided by the Participant, the Promoter shall not be obliged to make further investigation.
5.3. The risk of deterioration and accidental loss of the Gift shall pass to the Participant upon dispatch.
5.4. The delivery of the Gift will take place within 2 months after expiry of the Claim Period.
5.5. Claims pursued outside of the Claim Period, will not be accepted.
5.6. In the event, that the Promoter is not able to meet the delivery date stated in Section 5.4 for reasons for which the Promoter is not responsible (non-availability of the Gift), the Promoter shall inform the Participant of this without delay and at the same time notify the Participant of the expected new delivery date. A case of non-availability of the Gift in this sense shall be deemed to be, in particular, the failure of the Promoter´s supplier to deliver on time if the Promoter has concluded a congruent transaction, neither the Promoter nor it´s supplier are at fault or the Promoter is not obliged to procure in the individual case. A case of non-availability of the Gift shall also be deemed in the event of unforeseen circumstances such as any force majeure event.
6. PRIVACY & DATA PROTECTION
6.1. The responsible data controller is the Promoter, Panasonic Marketing Europe GmbH, Hagenauer Str. 43, 65203 Wiesbaden, GERMANY; email@example.com
6.3. The types of data collected: Salutation, first name and last name, postal address, country of residence and e-mail address, survey respond, date and place of purchase of the Qualifying Product.
6.4. The purposes of data collection: Data will be collected, processed and stored for the sole purpose performance of the promotion or as far as the Participant has consented to it. If the Participant consented into the reception of product information and special offers from Panasonic, the types of data listed above will also be collected, processed and stored for such purpose. Data of already existing customers will be compared and updated with the provided data of this promotion.
6.5. The data processing is based on Article 6 (1) (b) and (f) and Article 17 (3) (e) GDPR, namely on the voluntary participation of the Participant, these terms and conditions and the legitimate interests of the Promoter.
6.6. All personal data of the Participant will neither be passed on to third parties nor made available to them for use without their consent. An exception is made for third parties, which have been commissioned to carry out the Promotion, and which will collect, store and use the data for the purpose of carrying out the Promotion. The third parties comply with GDPR and have the necessary security measures in place as agreed with the Promoter.
6.7. The data of the Participants will be deleted after the performance of the Promotion, unless such data is necessary for the reception of product information and special offers from Panasonic. They will only be archived by the Promoter for legal defense purposes, at the longest until the statute of limitations for claims has expired.
6.8. The Participant can declare revocation of the participation in the Promotion to the Promoter at any time and object to the use of the respective personal data of the Participant for the Promotion. This revocation shall be addressed to the Promoter or Panasonic branch of the country the Participant resides.
6.9. The Participant has the right at any time to free information about the Participant´s stored personal data, its origin and recipient and the purpose of the data processing and, if applicable, a right to correction, blocking or deletion of this data within the framework of the applicable legal provisions.
7. GENERAL CONDITIONS
7.1. By claiming this Gift, Participants will be deemed to have read and accepted these terms and conditions.
7.2. The Promoter reserves the right to verify the eligibility of all claims to protect itself against fraudulent, invalid or repetitive claims including, without limitation, to require the Participant to prove that it did not return the Qualifying Product within the period of 28 days from the date of delivery. Claims for returned Qualifying Products, bad faith or fraudulent entries or claims that otherwise do not meet these terms and conditions will be invalidated.
7.3. The Promoter reserves the right to, and in its sole discretion, amend these terms and conditions at any time and to amend or withdraw this Promotion at any time.
7.4. Only one claim per Qualifying Product purchased can be made.
7.5 To monitor fraudulent claims the Promoter reserves the right to cross check product returns with the relevant authorized retailers against Gift claims received. Any potentially fraudulent activity will be followed up by the Promoter. The Promoter reserves the right to withhold the issuance of a Gift (or take steps to require return if already provided) where it is suspected that a false or fraudulent claim has been made.
7.6. These terms and conditions are governed by the laws of the Republic of Germany, to the exclusion of international conflict law, in particular the UN Convention on Contracts for the International Sale of Goods. The courts of Wiesbaden, Germany shall have exclusive jurisdiction to settle any dispute or claims arising out of this Promotion or in connection to it.
7.7. Should any clause of these terms and conditions be invalid the validity of the remaining terms and conditions shall remain unaffected.
